10.3 Either party may bring an individual claim in small-claims court if it qualifies.
10.4 You may opt out of this arbitration agreement by emailing info@blueheronhealthguides.com with the subject line "Arbitration Opt-Out" within 30 days of your first use of the Site, including your name, address, and the Site's URL.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Subject to Section 10, the state and federal courts located in Delaware have exclusive jurisdiction over any dispute that is not subject to arbitration.

12. Limits on exclusions of liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded under applicable law.

13. Severability and entire agreement

If any provision of these Terms is unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
